Two distinct obligations exist. They are frequently confused; they differ in legal
basis, frequency and form.

**Important distinction:** the appointment-grade brackets use a **15,000 ㎡**
boundary (시행규칙 별표), while the phase-in schedule above uses a **10,000 ㎡**
boundary (시행령 부칙). These are different rules from different instruments and
are commonly conflated.

Existing buildings are deemed compliant until the 시행령 부칙 deadlines:
30,000 ㎡ 이상 → 2025-07-18; 10,000–30,000 ㎡ → 2026-07-18;
5,000–10,000 ㎡ → 2027-07-18.

One 유지보수·관리자 may be concurrently appointed for up to **5 buildings**
(시행규칙 제9조제3항) where the 관리주체 directly employs them or has delegated
the work to a 공사업자.

Where 유지보수등 업무 is delegated to a 공사업자 under 법 제37조의4제1항, the
관리주체 is deemed to have appointed a 유지보수·관리자 (법 제37조의4제2항 단서).

### Who may perform

- **성능점검 대행**: ① 공사업자 — a party registered for 정보통신공사업;
  ② 용역업자 — a party notified as an 엔지니어링사업자 under 「엔지니어링산업 진흥법」
  or registered as a 기술사사무소 개설자 under 「기술사법」, holding qualifications in
  통신·전자·정보처리 or related ICT fields
- **유지보수·관리 위탁**: 공사업자 only. A 용역업자 may perform 성능점검 but
  **cannot** be delegated 유지보수·관리 업무. To place both with one contractor,
  that contractor must be a 공사업자.

Knowhow Electel is a registered 공사업자 and can therefore perform both.

### Record retention

Records must be retained for **5 years** and submitted on request from the
특별자치시장·특별자치도지사·시장·군수·구청장
(법 제37조의3제3항, 시행령 제37조의2제3항). The retention and submission duty
rests with the 관리주체.

Where a 성능점검 result is 부적합, the 공사업자·용역업자 that performed the
inspection may request the 관리주체 to carry out improvement, repair or
